Suggestions for celebration of GST Day





Some units have contacted me stating that their members wanted to boycott GST Day due to the unfair treatment meted out to us. The latest of course is that the department is likely to file a review petition against the Judgment in M. Subramaniam case (5400).  But considering that it is too short a time to consult all units and take any decision and since it is a transition time with the new Chairman taking over only at this point of time, no such decision is being taken now.

However, the above letter has been sent as suggested by our units to record the discontent in the cadre.

WELCOMING THE NEW CHAIRMAN

Dear Comrades and Friends,
 
WE WHOLE HEARTEDLY CONGRATULATE SHRI. S. RAMESH, THE PRESENT MEMBER (ADMN) UPON HIS ELEVATION AS THE CHAIRMAN OF CBIC.  HAVING BEEN DEALING WITH STAFF MATTERS FOR QUITE SOME TIME NOW, WE HOPE THAT DURING HIS TENURE AS CHAIRMAN, THE STAFF ISSUES PERTAINING TO CBIC WILL BE GIVEN TOP PRIORITY.
 
WE ALSO TAKE NOTE OF THE SITUATION WHERE PERFORMANCE BY CBIC IS BEING COMPARRED WITH THAT OF THE STATE GST.  IT IS PERTINENT TO REMEMBER HERE THAT SERIOUS STOCK TAKING OF THE MORALE OF THE STAFF OF THE DEPARTMENT IS THE URGENT NEED OF THE HOUR.  NEGLECT, DISPARITY AND DISCRIMINATIVE TREATMENT HAVE EATEN INTO THE ROOTS, THUS CREATING A HUGE TRUST DEFICIT.  WITH SUCH AN ESTRANGED CLIMATE WITHIN THE DEPARTMENT PERFORMANCE CANNOT REALLY IMPROVE.
 
WE HOWEVER FEEL THAT WITH THE NEW CHAIRMAN TAKING OVER THERE COULD BE CHANGES IN THE ATTITUDE OF THE BOARD TOWARDS THE STAFF ISSUES.
 
Various constituents of the COC during its meeting at Kolkatta had expressed a feeling that the present Chairman, CBIC is acting as if she is only the Chairman of the DR IRS.  The decision to conduct agitation programmes and express the displeasure of the cadres other than the DR IRS was taken accordingly. This sentiment was also expressed in the letter of the COC addressed to the Hon'ble FM and the Revenue Secretary.
 
Subsequently there have been some developments.
 
The Member (Admn) Shri. S. Ramesh who has been designated to be the new Chairman is understood to have taken a meeting with the officials of the Board on 07.06.2018 to discuss what issues in the COC Charter could be settled at the level of the Board and which have to be recommended to other departments.  The Officials of the Board and DGHRD have also called me for details on the charter of demands.
 
Subsequently, when the Member (Admn) visited Nagpur and met the COC local unit on 15.06.2018, he assured them that 'soon after he assumes charge of Chairman, he will be holding discussions with the stakeholders, and favourably consider all demands which can be settled at Board level, and initiate  necessary action in respect of the others.'  This has been communicated by Com. Rajiv Dalal, of Vidharba COC. 
 
Some of the constituents of the COC have also felt that in the above scenario, it is better to defer the DHARNA slated for 20.06.2018 to a later date so that time is given to the new Chairman to consider the demands.  Accordingly COC has deferred the Dharna as of now and are awaiting the meeting with the new Chairman after his assumption of office.
 
In the meanwhile it is also learnt that though the letter campaign from the members is continuing, the letters have not yet been forwarded through proper channels.
 
Hence all members and unit office bearers are requested to make the letter campaign a 100% success and see to it that they are forwarded through proper channels so that by the time we discuss the matter with the Board, the intensity of the feelings at the ground level get portrayed fully.

Recent letters to Board and Revenue Secretary








Dear friends and comrades,
Recent letters sent to the Board/Revenue Secretary are scanned and given above.  The issues need no explanation.
In the meanwhile it is learnt that the former SG is (as usual) spreading some canards through his blog saying that we have informed the Board that any further DPC to the post of ACs will have to be conducted only with another permission from the Hon’ble Supreme Court. We have not made any reference to any authority regarding the DPC. We are given to understand that the former SG and a hand full of his friends are seeking money from the persons standing promoted as ACs in the last order and who are likely to be covered in the next DPC.  In this regard, the following points are reiterated, some of them at the cost of repetition:
1 1) The SLP in the Bharathan case and IA seeking permission to hold DPC for 600   posts of ACs was filed only by the CBIC.
   2) They could have very well said only numerous AC posts or even 1400 plus posts    as originally contemplated.
   3) The remaining number of posts is most probably lying vacant in the regular AC    stream and would flow down to the Temporary stream only after the DPC to    regularise the temporary ACs are conducted.
  4) We are given to understand that the UPSC had taken a stand in the case of promotion to ACs in Income Tax that DPC would be conducted only after implementation of the Parmar Judgment.
   5)  This could have been the reason for the CBIC initially proposing to fill up more posts but later specifically stating repeatedly before the Hon’ble Supreme Court that they wanted to fill up 600 posts.
  6) The former SG had absolutely no role in the proceedings before the Hon’ble Supreme Court in the above SLP or the IA because his IA seeking to be permitted to file counter in the name of AIACEGEO has not been allowed by the Hon’ble Court at all.
   7) On the other hand, a reply/rejoinder to our counter affidavit has been filed by the CBIC before the Hon’ble Supreme Court.
    8) When the CBIC itself had filed an IA requesting the Court to permit them to hold an adhoc DPC until the disposal of the SLP, the former SG who is an AC himself had no requirement to seek a DPC and had no locus standi.
   9)  His entire projection as if he got the DPC conducted is a direct attack on the stature of the Board and the judiciary.
   10) Any one supporting such a propaganda is knowingly or unknowingly permitting him and his friends to collect huge money from gullible promotion starved Superintendents and perhaps also in getting postings subsequently.

There have been certain posts in some WhatsApp groups regarding unification of two factions of the AIACEGEO.  In this regard, the AIEC to meet at Bangalore will discuss and decide on the further course of action.  All our 24 Units are to participate in the said meeting.  The remaining 6 to 8 units where elected office bearers are functioning have also been invited to be Special invitees/observers and give their views, as well as to see for themselves, where the majority of the cadre is and what they feel.
