Vacancy position in AC Cadre - RTI Info








Dear friends and comrades,
There have been various speculations regarding the DPC, the number of vacancies in the regular stream, temporary stream etc.  Though promotions to the regular posts of ACs have not been ordered from 2012, the statistics given out regarding the actual vacancies had not been tallying.  Members and unit office bearers have been raising a doubt regarding whether the actual vacancies are getting filled up as per the correct ratio and why regular posts are not being filled up in DPCs.
Income Tax comrades informed us that in their case the UPSC had made a noting with regard to a particular year vacancy being filled up stating that DPC will not be held until the N.R.Parmar case is implemented.  Subsequently IT department had implemented the same.
It was doubted that due to the same reason the regular vacancies in our department also had not been filled up since UPSC could not have taken a different stand.
It is because of this reason that we have repeatedly insisted upon the Board that the Parmar judgment be implemented as done in the CBDT.
Even in the Charter of Demands, we have asked the CBIC to implement it at least from 1.3.86, the date from which ‘they’ do not have any difference regarding implementing it because the period before that only is in dispute in their SLP.
The Chandigarh CAT also is understood to have taken a similar stand in a recent order in an OA filed by our Department colleagues.
In order to get at the actual facts, we had to resort to RTI to get the break up of the vacancy position.

Without comments on the methodology of handling the issue, it may just be seen how the information has been provided for two different dates, thus ensuring that no comparison or correlation is possible.
Further exploration could be attempted.

    Lot of aspects need investigation to find out rot & forces acting in favour of PA, and against PE.
