I received calls from many saying that there is some post by Mr. Ravi Malik assuring the Chennai persons who are involved in a stay and have filed contempt in High Court that their interests will be watched. It is unfortunate that my opinion of what he meant is sought.
In my understanding, the CBEC has decided to file SLP and has also already filed the same against the orders of the Hon'ble HIgh Court of Chennai in the matter of implementation of the N R Parmar decision of the Hon'ble Apex Court.
Obviously the department cannot go to the Apex court with a plea that they may be allowed to flout the orders of the Apex Court itself.
Time and again we have been requesting the Board to issue clear instructions to the field formations in the style of the CBDT and seek relief from the Court stating that the promotions may be permitted to be made on adhoc basis, with an undertaking that the Parmar judgement will be implemented within such and such time frame. We also will support such a stand because the vacancies cannot go unfilled.
But the language of watching only the interests of Chennai people, gives a different meaning.
That the decision could be implemented only in the case of the petitioners.
That will again be a miscarriage of justice.
That is definitely not the way to take care of every one's interest, atleast, those on the same pedestal.
